Terms of Service

These terms are an agreement between you and ACEX International Limited ("ACEX", "we", "us"), a company registered in England and Wales, and they govern your use of the AXIS app, the waitlist, and this website. By joining the waitlist or using the app, you accept them. If you do not agree, please do not use the service.

Who can use AXIS

You must be at least 16 years old to join the waitlist or create an account. By using AXIS you confirm that you are. If you are using it on behalf of an organisation, you confirm you are allowed to accept these terms for them.

Access and the waitlist

AXIS is invite only for now. Joining the waitlist does not guarantee access, and we may invite people in any order we choose. We may also limit, pause, or close the waitlist at any time.

Your account

You are responsible for the activity on your account and for keeping your login secure. Give us accurate details and keep them up to date. Tell us promptly if you think someone else has gained access. You can sign in with a one-time code or a password, and you should not share either with anyone.

What AXIS is, and what it is not

AXIS is a mental performance and training product. It offers guided audio sessions, tools to record and reflect on your training, and an in-app coach. It is meant to support performance, focus, and self-reflection.

AXIS is not a medical device and does not provide medical, psychological, or therapeutic care. It is not a substitute for advice from a qualified professional. Nothing in the app diagnoses or treats any condition. If you are struggling with your mental health, please speak to a doctor or a qualified professional. If you are in crisis or think you may harm yourself, contact your local emergency services or a crisis line straight away. Do not rely on AXIS in an emergency.

Subscriptions, trials, and billing

Some parts of AXIS need a paid subscription. Payments are handled by Stripe, and by subscribing you also accept Stripe's terms. Unless stated otherwise:

• a subscription renews automatically at the end of each billing period until you cancel;
• we charge the payment method on file at the start of each period, at the price shown when you subscribed;
• if your invite includes a free trial, we will not charge you until the trial ends, and you can cancel before then to avoid being charged;
• you can cancel at any time, and your access continues until the end of the period you have already paid for.

If you subscribe through the Apple App Store or Google Play, billing, renewals, and refunds are handled by that store under its own rules, and you manage or cancel the subscription through your store account. We may change our prices, and we will give you notice before a change affects you. Except where the law gives you a refund right, payments are non-refundable.

Your content

Your voice notes, transcripts, written notes, debriefs, and messages to the coach are yours. You keep all rights to them. You give us a limited licence to store and process this content for the sole purpose of running the service for you, which includes transcribing your audio and generating coach replies. We do not use your personal content to train public models, and we do not sell it. The Privacy Policy explains how we handle it.

Automated and AI features

The transcription and coaching features are automated. They can be inaccurate or incomplete, and the coach is not a human and not a professional adviser. Use your own judgement, and do not treat its output as medical, legal, financial, or psychological advice.

How you may use AXIS

You agree not to:

• use the app for anything unlawful, or to harm or harass anyone;
• copy, resell, or redistribute the sessions or other content;
• reverse engineer the app, interfere with its security, or try to access accounts or systems that are not yours;
• scrape the service or hit our systems with automated requests that disrupt them.

We may suspend or close accounts that break these rules.

Our content

The sessions, audio, text, design, software, and the AXIS and ACEX names and logos belong to us or our licensors. We give you a personal, non-transferable licence to use them through the app for your own training while your account is in good standing. You get no other rights.

Availability and changes

We are still building AXIS, so features may change, and the service may sometimes be unavailable while we maintain or improve it. We may add, change, or remove features, and we may stop offering the service. If we plan to close it down, we will give you reasonable notice so you can retrieve your content.

Disclaimers

We provide AXIS with reasonable care and skill. Beyond that, and to the extent the law allows, the app is provided "as is" without further warranties. We do not promise that it will be uninterrupted, error free, or that it will produce any particular result for you.

Liability

Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by our negligence, or for fraud. Subject to that, we are not liable for loss that we could not reasonably have foreseen, for loss arising from your reliance on the app instead of professional advice, or for events outside our reasonable control. Where we are liable, our total liability to you is limited to the amount you paid us in the twelve months before the claim. Some countries do not allow certain limits, so parts of this section may not apply to you.

Ending these terms

You can stop using AXIS and ask us to close your account at any time by emailing privacy@acexos.com. We may suspend or end your access if you break these terms or if we have to for legal or security reasons. Terms that should survive the end of this agreement, such as the sections on your content, liability, and governing law, will continue to apply.

If you installed AXIS from an app store

These terms are between you and us, not with Apple or Google. The store is not responsible for the app or its support, and it is not party to these terms. If the app fails to meet a warranty that cannot be disclaimed, Apple may refund your purchase price where its rules require, and beyond that has no other warranty obligation. You confirm you are not on a country subject to a relevant trade embargo and are not on a prohibited-parties list. Apple and Google are third-party beneficiaries of these terms and may enforce them against you. You also agree to follow the store's own terms of service.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute. If you are a consumer, you keep the benefit of any mandatory protections of the country you live in.

Changes to these terms

We may update these terms as the product develops. We will post the new version here and change the date at the top. If a change is significant, we will tell you in the app or by email. If you keep using AXIS after a change takes effect, you accept the new terms.
